On 11 December 2018, the Co-Registrars of MIAC, Ms. Susan Kimani and Ms. Ashwita Ambast, met with the Secretary-General of the Permanent Court of Arbitration, H.E. Mr. Hugo H. Siblesz, at the PCA headquarters in The Hague. The MIAC Co-Registrars and the PCA Secretary-General discussed, among other things, the ongoing cooperation between MIAC and the PCA and the MIAC Arbitration Rules.
The MIAC Arbitration Rules were published on 27 July 2018, and are modelled on the widely used 2010 UNCITRAL Arbitration Rules. The PCA Secretary-General serves as the appointing authority under Article 6 of the MIAC Arbitration Rules. In this capacity, he assists parties to arbitrations governed by the MIAC Arbitration Rules in the constitution of tribunals, in deciding challenges to arbitrators, and in reviewing the fees and expenses proposed by tribunals and the costs of arbitration. In this respect, MIAC Arbitration Rules rely on a similar mechanism as the 2008 Mauritius International Arbitration Act.
The PCA Secretary-General remarked that: “The PCA has thus far handled over 730 appointing authority requests. In my role as the appointing authority under the MIAC Arbitration Rules, I am intent on bringing my extensive international experience with the appointing authority mechanism to MIAC arbitrations.” He then added that: “My role under the MIAC Arbitration Rules supplements the PCA’s arbitration work in Mauritius under the Mauritius International Arbitration Act and in promoting Mauritius as a state-of-the-art arbitration jurisdiction.”
